Military law consists of the Uniform Code of Military Justice and other statutory provisions for the government of people in the Armed Forces. There may be added the unwritten common law of the usage and custom of military service as well as regulations and authorized by the current President, as Commander in Chief of the Armed Forces.

Military law is not complex in nature and pertains to every branch of the armed forces of the United States of America.

When members of any branch of the Armed Services are accused of committing a crime, their direct commander is the officer who decides how to handle the case. The soldier accused can receive a military trial, known as a court-martial. The most serious of military court cases are court-martials. In a court-martial, the military judge can award any authorized punishment, including death in capital cases.

There are three kinds of court-martials:

  • General Courts-Martial
  • Special Courts-Martial
  • Summary Courts-Martial

General courts-martial are relegated for felonies and more serious crimes. The panels that hear them, which are similar to civilian juries, must consist of at least five members of the military. Special courts-martial are designated for less serious crimes. Panels must consist of at least three non-civilian members. Summary courts-martial are for resolving relevatively minor issues involving enlisteds. They are heard before one judge who also awards the sentence.
